The Regulation (EU) 2023\/2405 of the European Parliament and of the Council of 18 October 2023 on ensuring a level playing field for sustainable air transport, in short \u2018ReFuelEU Aviation\u2019, requires that each Member State indicates a National Competent Authority (NCA) to implement the provisions contained therein.
\nThe Italian Ministry of Transport and Infrastructure has designated ENAC as the competent authority for Italy and ENAC is therefore entrusted with the task of monitoring the correct fulfilment of legal obligations by aircraft operators, aviation fuel suppliers and airport management bodies, making use of the tools made available by DG-MOVE and EASA.<\/p>\n

To this end, ENAC has further structured itself through the establishment within the Environment and Sustainable Mobility Department of the \u2018National Competent Authority Offi ce for RefuelEU Aviation\u2019, as theorganisational structure responsible for defining and implementing the processes necessary for the correct implementation of the \u2018ReFuelEU Aviation\u2019 Regulation. These are summarised as follows:<\/p>\n\n\n\n\n\n\n\n\n\n\n

Reporting<\/strong><\/td>\nVerify compliance with reporting obligations by aviation fuel suppliers and obliged aircraft operators, contributing to the annual update of the lists of obliged entities and \u2018Union airports\u2019<\/td>\nArt. 8, 9, 10<\/td>\n<\/tr>\n
Penalties<\/strong><\/td>\nTo issue the penalties, providing for the annual update of the amounts<\/td>\nArt. 12<\/td>\n<\/tr>\n
Anti-Tankering<\/strong><\/td>\nVerify compliance with the refuelling obligation by aircraft operators, assigned administratively to Italy in accordance with Regulation (EC) No 748\/2009, and subject to an obligation<\/td>\nArt. 5(1)<\/td>\n<\/tr>\n
Exemptions<\/strong><\/td>\nApprove or reject requests for temporary exemption from the refuelling obligation by obliged aircraft operators with flights departing from \u2018Union airports\u2019 located in Italy<\/td>\nArt. 5(3)<\/td>\n<\/tr>\n
Justifications<\/strong><\/td>\nExamine the justifications for non-refuelling for safety reasons by obliged aircraft operators with flights departing from \u2018Union airports\u2019 located in Italy<\/td>\nArt. 5(2)<\/td>\n<\/tr>\n
SAF supply<\/strong><\/td>\nVerify the achievement by aviation fuel suppliers of the minimum shares of sustainable fuels made available at \u2018Union airports\u2019 to obliged aircraft operators<\/td>\nArt. 4<\/td>\n<\/tr>\n
