EDD: EXAMINER DIFFERENCES DOCUMENT

Information on national procedures for examiners holders of certificates
issued by EASA Member States other than Italy. Procedures effective from July the 5th , 2018, revised on July the 5th  Ref. to EU 1178/2011, EU 290/2012, EU 245/2014 - Annex I Subpart K Examiners art. FCL.1015(c) and Annex VI Subpart FCL art. ARA.FCL.205(c) and ARA.FCL.210.

1. Introduction

Holders of examiner certificates issued by EASA Member States other than Italy wishing to conduct skill tests (ST), proficiency checks (PC) or Assessments of Competence (AoC) of an applicant for which Italy is the Competent Authority, are required to review the latest available information about the applicable ENAC procedures (ref. art. FCL.1015(c)).

As required by the requisite ARA.FCL.205(c), ENAC has developed procedures for designation of examiners whose certificates has been issued by EASA Member States other than Italy who intend to accomplish ST, PC, or AoC other than Examiner AoC. Such procedures have been notified to EASA (ref. art. ARA.FCL.210). 

For monitoring purposes, ENAC may perform, at its discretion, inspections  during the ST, PC, AoC; in these cases ENAC will inform the examiner in due time; if during the monitoring activities ENAC inspector finds non compliances with the applicable requirements or national procedures, he/she has shall  raise findings or invalidate the ST, PC, AoC.

2. Designation Procedure applicable to examiners for ST, PC, AoC
  • before any ST, PC, AoC for revalidation or renewal, is conducted the examiner shallbefore any ST, PC, AoC is conducted the examiner shall:
     
    • fully acquaint himself/herself with Liability, Accident Insurance and Personal Data Protection information reported hereafter;
    • fully acquaint himself/herself with Safety Criteria published in ENAC website at the page: Prescrizioni Operative
    • download the "notification template" from ENAC web-site, "info in English" section, examiners' forms page;
    • insert all data in accordance with the guidelines provided in the template itself;
       
    • when completed  submit at least 15 days for AoC revalidation/renewal of an examiner or instructor certificate.
    • 1 day for LPC, Class rating or IR PC check;
    • 7 days for Still test, type or class rating;
    • 7 days for ATPL, CPL, IR, PPL, LAPL, SPL, BPL
    • Prior to the ST, PC or AoC the "notification template" as an attachment to an e-mail with the standardized subject FOREX/NTF/[EXAMINERSURNAME] (e.g.: if the examiner is Mr. John Smith the subject shall be FOREX/NTF/SMITH), to be sent to examiner.notification@enac.gov.it;
       
  • the examiner may then proceed to administer the ST, PC, AoC. Nofurther written authorisation will be issued by ENAC;
  • examinations shall be conducted using a language for which both examiner and candidate hold a valid language proficiency of at least level 4;
  • after the ST, PC, AoC the examiner shall follow the Reporting Procedure described below;
  • ENAC will refuse ST, PC, AoC when any of the examiner's personal license, rating or certificate is expired at the time of examination;
  • adherence to the above procedure authorises the examiner to revalidate or renew ratings or certificates as follows (endorsement of the pilot licence as per ARA.FCL.200(c)):
    • the examiner may only enter the revalidated or renewed rating or certificate in the pilot’s licence if the rating is still present in the licence;
    • if the rating or the certificate is no longer present in the licence ENAC shall reprint the licence with the new or renewed  rating;
3. Designation Procedure applicable for AoC initial issue of an examiner or
instructor certificate

Examiners or Instructor Assessment of Competence is permitted provided a written Individual Authorisation for  Assessment of Competence issued in advance by ENAC. 

As required by art. ARA.FCL.205(c), ENAC procedures for designation
of examiners whose certificate has been issued by EASA Member States other than Italy who intend to accomplish Examiner or Instructor
AoC, are as follows:

  • before any Examiner or Instructor  AoC is conducted, the examiner shall:
    • fully acquaint himself/herself with Liability, Accident Insurance and Data Protection information reported hereafter;
    • fully acquaint himself/herself with Safety Criteria published in the ENAC web site at page Prescrizioni Operative;
    • submit at least 30 days before the intended assessment of competence an application for an Individual Authorisation for Assessment of Competence to ENAC Direzione Personale di Volo, by email, to istruttoriesaminatori@enac.gov.it for the assessment of competence;
  • the application sent by email shall report at least the following data:
    • examiner name;
    • examiner e-mail address and mobile phone number;
    • candidate name;
    • description of Examiner AoC to be carried out, including type of aircraft or FSTD operator;
    • expected place, date and time of AoC.
  • the examiner will receive by ENAC the Individual Authorisation for Examiner Assessment of Competence;
  • before any AoC or ST is conducted, the examiner shall: 
    • download the "notification template" from ENAC web-site, "info in English" section, examiners' forms page;
    • insert all data in accordance with the guidelines provided in the template itself;
    • when completed, submit the "notification template" as an attachment to an e-mail with the standardized subject FOREX/NTFIA/[EXAMINERSURNAME] (e.g.: if the examiner is Mr. John Smith the subject shall be FOREX/NTFIA/SMITH), to be sent to  examiner.notification@enac.gov.it;
  • the examiner may then proceed to administer the AoC according to the Individual Authorisation for Examiner Assessment of Competence;
  • AoC shall be conducted using a language for which both examiner and candidate hold a valid language proficiency of at least at level 4;
  • after the AoC the examiner shall follow the Reporting Procedure described below, providing the complete set of updated documents;
4. Reporting Procedure

After completion of a ST, PC or AoC, the examiner shall report the activity through the applicable ENAC forms. The reporting shall include:

  •  a Report Form for ST, PC or AoC, as applicable (which shall enclose the proper Check List and the declaration required by FCL.1030(b)(3)(iv) that the examiner has reviewed and applied the ENAC national procedures), and the following attachments:

° Flight time of the check, test or AoC;
° copy of the statement of the ATO which confirms the required training
has been completed (if applicable);
° copy of FSTD approval certificate (if applicable);
° copy of the examiner's licence;
° copy of the examiner's certificate;

° copy of the examiner's medical certificate;
° copy of endorsed licence (if entry on licence is made by examiner).

When completed, the examiner shall submit as soon as possible:

  • the original signed paper form and the relevant attachments to the candidate (FCL.1030(b)(3));
  • and in addition, a scanned copy in .pdf format of the signed paper form and the relevant attachments as enclosures to an e-mail with the standardized subject FOREX/RPT/[EXAMINERSURNAME] (e.g.: if the examiner is Mr. John Smith the subject shall be FOREX/RPT/SMITH), to be sent to examiner.notification@enac.gov.it
  • it will be the duty of the candidate to provide the original signed paper form and attachments via PEC (protocollo@pec.enac.gov.it) to: ENAC Direzione Personale di Volo, Viale Castro Pretorio 118, Rome, 00185 - Italy, only for the issuance of ATPL, CPL and IR, issuance/revalidation/renewal of any instructor certificate and/or examiner certificate.

It will be the duty of the candidate to provide the original signed paper form and attachments via PEC (protocollo@pec.enac.gov.it) to ENAC Airport Directions https://www.enac.gov.it/passeggeri/diritti-dei- passeggeri/reclami/recapiti-utili/recapiti-delle-direzioni-degli-uffici-dellenac (that has to be written in the object) of his/her choice for all the other cases of issuance/revalidation/renewal.

5. Fees

ENAC does not provide any financial remuneration for expenses or services rendered. Any compensation shall be arranged by the examiner with the training organisation or the candidate.

6. Liability and Accident Insurance information

ENAC does not provide liability or accident insurance for the conduct of ST, PC, AoC, either in an FSTD or in an aircraft. It is responsibility of the examiner to ensure that he/she, and the test devices, are adequately insured against incident, accident or liability issues for the specific scope. Examiners are advised to seek professional advice concerning
appropriate insurance covering their activities as certified examiners.

7. Personal Data Protection information

Obligations and responsibility of the examiner, concerning protection of
personal and sensitive data, are prescribed by Italian Law DL 196/2003,
in line with the EU Data Protection Directive 95/46/EC. The law provides
definitions and modalities for processing data and is available in English
