Non-EU Carriers - Overflight of Italian territory

The International Convention (signed at Chicago on December the 7th,1944, ratified by Italian law n.306/83) lays down, for the signatory states, the freedom of overflight and stop for non-traffic purposes.

Article 794 of the Italian Navigation Code, as modified and updated by Legislative Decree n.96/2005 and subsequent amendments, reaffirms the freedom to fly across the Italian territory without landing insofar as laid down by international and EC law.

Carriers of member States of the Air Service Transit Agreement (signed at Chicago on December the 7th,1944, ratified by Italian law n.306/83) or carriers of States which are not members of the Transit agreement but which grant freedom of overflight and technical stop on a reciprocity basis, the overflight is granted on the base of the notification of the flight.

Carriers of States which are not members of the Transit Agreement or which do not reciprocally grant overflights and technical stops, has to obtain the authorization for overflight on the Italian territory or to perform a technical stop.

Procedure and documents to submit

Both carriers who are required to notify and carrier who have to obtain a permission will have to communicate through the e-mail overflights@enac.gov.it using the application form predisposed by Enac and available in the section reserved to the standard forms.

Carriers subject to advance authorization applying for the first time in order to carry out a stop for non-traffic purpose on the Italian territory must supply the following documents:

  • copy of AOC;
  • copy of an Insurance certificate, to be kept in force for the period covering the requested operations, issued according to the attached form, pursuant to EC Regulation 785/04 on minimum insurance requirements for carriers operating within the EC territory.

Carriers not subject to advance authorization applying for the first time in order to carry out a stop for non-traffic purpose on Italian territory are requested to forward a copy of the Air Operator Certificate and, in case of landing, a copy of a valid insurance certificateRelated document.
