Technical Flight Authorisation to overfly and land in the Italian territory of aircraft whose airworthiness certificate is not complying with ICAO standard

The International rules concerning the airworthiness of the aircraft are established in Annex 8 to the ICAO Chicago Convention. They require aircraft to be granted with a valid certificate of airworthiness and that it is in accordance with the standard model given in the same Annex.

Aircraft registered in a foreign country that do not meet all or part of the airworthiness standard of ICAO Annex 8, and therefore have a certificate of airworthiness that does not comply with Annex 8, are authorized to overfly and land in the Italian territory provided that they meet the conditions provided for in the ad hoc regulation “Navigation of aircraft whose airworthiness certificate is not complying with ICAO standard” published on ENAC’s website and in the AIP Italia.

Homebuilt and historical aircraft registered in ECAC member states or Aircraft registered in EASA member state

These aircraft are authorised to overfly and land in the Italian territory without prior authorization of ENAC. The maximum duration of operations in the Italian territory is limited to 28 continuous days, counted from the date of entry into the Italian air space.
Operators intending to carry out operations in the Italian territory are required to notify ENAC – Product Certification Department, at least 3 working days prior to entering the national airspace, through the e-mail address technical.flightauthorisation@enac.gov.it the date and the airport / airfield-helipad of entry and any airports / airfields-helipads where they intend to operate during their stay in Italy.
Product Certification Department will inform the Airports Departments concerned.
These aircraft may be included in the ENAC Ramp Inspection Program as required by Regulation (EU) No 965/2012.

Aircraft registered in non-EASA member states

These aircraft are allowed to fly over and land in the Italian territory following a specific authorization issued by ENAC. The authorization is limited to the period strictly necessary to carry out the intended flight activity but, in any case, it cannot exceed 28 continuous days counted from the date of entry into the Italian airspace.

Operators intending to overfly the Italian airspace or carry out operations at Italian airports, shall submit an application to Product Certification Department, forwarding the form filled in all its parts, and attaching the documents specified therein, to the certified email address protocollo@pec.enac.gov.it or, in the absence of a certified email account, to the email address technical.flightauthorisation@enac.gov.it
The Product Certification Department will inform the concerned Airports Departments.

Warning
ENAC informs that false declarations (documentation not conforming to the original), infringements or lack of notification will be notified to the competent authorities, including the Civil Aviation Authority of the State of registration, and will be sanctioned in accordance with current regulations.
